Just an Observation on the I-Word
Impeachment is a political process. It has very little to do with legality, in spite of the wording of the Constitution. If the Clinton impeachment process taught us anything, it is that impeachment is fundamentally a political question. Everyone involved has to couch what they do in legal terms, and there’s even a trial, but at the end of the day it is a political, not a legal, process.
That’s why I don’t think it matters what all of these legal scholars coming out of the woodwork say, for or against. The only way Bush gets impeached is if through some miracle Democrats retake both houses of congress next year and grow some Feingoldian balls.
And as regards the current meme that Bush isn’t the first president to go around FISA: The assertion that Clinton did it, too, is incorrect. Besides, “Clinton did it, too!” is hardly a defense. You know you are in trouble when you have to hide behind that paragon of virtue.
